IP Staff Attorney - Electronic Frontier Foundation (EFF)About EFF: The Electronic Frontier Foundation (EFF) is theleading organization defending civil liberties in the digital world. The Role: Staff Attorneys advancedigital rights by means of integrated legal advocacy, including developing andprosecuting substantive lawsuits, filing amicus briefs, counseling clients,enforcing public records requests, lobbying legislators, communicating with thegeneral public, helping develop EFF policy, and supporting the work of EFF'sactivists and technologists.
For this position, we are looking for candidates withexperience litigating copyright issues. Experience with or a strong interest inpatent law, artificial intelligence, unfair competition, and administrative, ortrade secret litigation is preferred but not required.
The idealcandidate will have at least 3 years of litigation experience, though somequalified candidates may have more. That experience should include devising andcarrying out case strategy and handling day-to-day projects and deadlines.
Responsibilities: Managing all aspects of litigation, including: Case and issueidentification; factual development and investigation; legal research andwriting; client identification and communications; co-counsel identificationand communications where needed; and formulation of legal strategyLitigating in federaland state courts, including meeting and management of deadlines; researchingand drafting pleadings; client relationship management and communication; coordinating and communicating withattorneys outside EFF (opposing counsel, co-counsel, parties' counsel, etc.);identifying and coordinating with outside experts and amici curiae; and courtappearances and oral argumentCoordinating withother teams at EFF concerning interests implicated by litigation andformulating press strategySubmitting amicusbriefs in non-EFF litigationDeveloping and communicating EFF policy positions,including:
Identifying andarticulating policy positions on emerging tech issuesCoordinating andparticipating in discussions across teams and subject-matter experts at EFF,including through participation in the EFF working group process, on thedevelopment of policyFactual and legalresearch and writingCollaborating withother stakeholders (NGOs, companies, academics) and subject-matter expertsoutside EFF on the development of, and advocacy for, EFF policyCommunicating policypositions to government through testimony, formal comments, or other direct orindirect communications (e.g., administrative/regulatory rulemakings, lobbying)Counseling clients on non- or pre-litigation matters: Conducting intake ofpotential clientsIdentifying legalissues, conducting legal research, and assessing legal risk for clientsCommunicating risks toclients and counseling about legal options and alternatives for avoiding risksMaintainingcommunication and relationships with clients, which includes addressingquestions and concernsCommunicating withadverse parties (e.g., responding to demand letters)Communicating EFF positions to the public, including:
